Question by Natty: How do I become legal guardian for my kids ?
I was notified that my kids are receiving an inheritance but I have to become their legal guardian to accept the funds. I thought i was already their guardian. They live with me and their father, and we are legally married. The court charges to just get the documents, then we have to appear before the court. Is all this really necessary? I live in Florida and the $ is coming from Ohio.
We are the birth parents and married to each other. The financial institution that the money is coming from says they still need guardianship papers.

The court needs proof that you two are the legal parents of the children. Contact your Family Law Court and find out what you need to do. They will help you through this. Good luck.

    Your birth certificate, the kids’ birth certificates, and your marriage license should be enough to prove you are their legal guardian. Contact the attorney (or executor of the will) who told you about their inheritance. He/she can answer any questions.

    are you the birth mother of the kids? then all you need is the birth certificates. are you the adopted mother, then you need the adoption docs and amended birth certificate. are you neither? then who are you?
